Tharrington Smith Education Attorneys Successfully Defend School Board Against Suit Seeking Confidential Records

North Carolina Superior Court Judge Lucy Inman has issued an order in favor of Tharrington Smith client, the Alamance-Burlington Board of Education, dismissing a lawsuit filed against it by the Times News Publishing Company.

The Times News filed suit against the Alamance-Burlington Board of Education, seeking an order compelling disclosure of confidential personnel information contained in closed Board meeting minutes. Tharrington Smith Attorneys Kathleen Tanner Kennedy, Rod Malone, and Rebecca Fleishman filed a motion to dismiss on behalf of the Board. The court’s order granted the motion, holding that the records sought by the Times News were not subject to disclosure under North Carolina law.
