Tharrington Smith defended a government contractor and its owner in a complex False Claims Act civil lawsuit brought by the federal government on behalf of the Department of the Army. The government claimed damages in excess of $9,000,000. Following discovery and extensive briefing, the District Court granted summary judgment. The District Court later denied the government’s motion for reconsideration. The government appealed but, before briefing, the parties reached a settlement in which the government dismissed its appeal and our clients agreed only to release their claims for litigation costs and fees.
